TikTok says the law is on its side as it prepares to fight US ban

(Bloomberg) — TikTok said legislation passed by the U.S. Congress late Tuesday that would force its Chinese parent company to sell its stake or face a complete ban on the app in America is “unconstitutional” and that the company will challenge it before the courts.

“We believe that the facts and the law are clearly on our side, and that we will ultimately prevail,” TikTok said in a post on X.

TikTok executives have remained largely silent since Congress moved to fast-track legislation against the app by tying it to a package of bills that included foreign aid to Ukraine and Israel. The move aims to address national security concerns that the Chinese government could access user data or influence what is seen on the app through TikTok’s parent company, ByteDance Ltd.

ByteDance would have less than a year to divest its stake before a ban takes effect. Before any form of separation, TikTok intends to exhaust all legal avenues to challenge the bill.
