House GOP Conference Chairwoman Elise Stefanik, R-N.Y., files ethics complaint against special counsel Jack Smith Tuesday, accusing him of violating Department of Justice (DOJ) standards and attempting to swing the election against former President Trump.

In a letter sent to the DOJ’s Office of Professional Responsibility, Stefanik urged the government watchdog to investigate Smith on charges of “abusing federal government resources to illegally interfere with the 2024 presidential election.” .

“Jack Smith’s multiple attempts to rush to trial in the January 6 federal case against President Trump violated an explicit and long-standing Department of Justice policy,” Stefanik wrote.

“Furthermore, Jack Smith’s repeated violations of the stay of proceedings of the United States District Court for the District of Columbia constitute an unlawful violation of trial ethics and attorney conduct. Jack Smith’s actions have brought the Department of Justice and the federal government as a whole into disrepute, and he should face discipline appropriately.

The former U.S. Attorney and human rights prosecutor has repeatedly asked the high court to reject Trump’s requests for immunity and move to delay his trial, including to April 8.

Stefanik’s complaint accused him of first trying to influence the August 2023 election, when Smith asked for January 2, 2024 trial.

She also cited Smith’s petitions to the Supreme Court and used her own comments in court that no American is “above the law” as a further argument that he should support an investigation into his conduct.
